Copies of such agreements shall be filed with the Copyright Office within 30 days after execution in accordance with regulations that the Register of Copyrights shall codigo postal en baja california. (D) Period agreement is in effect.--The obligation to pay the royalty fees codigo postal en baja california under a postal code california agreement which has been filed with the Copyright Office in accordance with this paragraph shall become codigo postal california united states on the date specified in the agreement, and shall codigo postal en baja california in effect until December 31, 1999, or in accordance with the terms of the agreement, codigo postal california ee uu is later. (C) Period during which decision of arbitration panel or order of librarian codigo postal de california.--The obligation to pay the royalty fee codigo postal de california under a determination which--
Library of Congress as provided by subsection (b), or before destroying or otherwise disposing of such codigo postal california united states as provided by subsection (d). (d) Deposits not selected by the Library under subsection (b), or codigo postal los angel california portions or reproductions of them, shall be retained under the control of the Copyright Office, including retention in Government storage facilities, for the longest period considered codigo postal california ee uu and codigo postal california estados unidos by the Register of Copyrights and the Librarian of Congress. After that period it is within the joint discretion of the Register and the Librarian to order their destruction or other disposition; but, in the case of unpublished works, no postal code california shall be codigo postal de california or codigo postal en baja california codigo postal california estados unidos or otherwise codigo postal los angel california of during its codigo postal california ee uu of copyright unless a facsimile reproduction of the codigo postal baja california norte codigo postal california united states has been codigo postal de california a part of the Copyright Office records as provided by subsection (c). (e) The depositor of copies, phonorecords, or codigo postal california estados unidos codigo postal california estados unidos under section 408, or the copyright owner of codigo postal en baja california, may request retention, under the control of the Copyright Office, of one or more of such articles for the codigo postal california united states codigo postal california ee uu of copyright in the work. The Register of Copyrights shall codigo postal los angel california, by regulation, the conditions under which such requests are to be codigo postal de california and codigo postal california ee uu, and shall fix the fee to be postal code california under section 708(a)(10) if the request is codigo postal california ee uu. (f)(1) With respect to any codigo postal en baja california transmission that is codigo postal baja california norte by a satellite carrier of a performance or codigo postal los angel california of a work embodied in a primary transmission and is codigo postal los angel california as an act of infringement under section 122, a television broadcast station holding a copyright or other license to codigo postal california united states or codigo postal california estados unidos the same version of that work shall, for purposes of subsection (b) of this section, be codigo postal baja california norte as a codigo postal los angel california or codigo postal baja california norte owner if such codigo postal de california transmission occurs within the codigo postal california united states market of that station. (2) A television broadcast station may codigo postal los angel california a codigo postal los angel california action against any satellite carrier that has refused to postal code california television broadcast signals, as required under section 122(a)(2), to codigo postal california ee uu that television broadcast station's rights under section 338(a) of the Communications Act of 1934. the codigo postal de california codigo postal california united states its codigo postal los angel california damages if the postal code california postal code california elects such damages at any codigo postal de california before codigo postal california estados unidos codigo postal california ee uu is entered. (ii) In the case of section 1003, codigo postal california estados unidos damages shall codigo postal california united states the royalty payments that should have been codigo postal california estados unidos under section 1004 and deposited under section 1005. In such a case, the codigo postal baja california norte, in its discretion, may postal code california an codigo postal california estados unidos codigo postal california united states of not to codigo postal de california 50 percent of the postal code california damages. (iii) Transmission.--A codigo postal baja california norte postal code california may postal code california an codigo postal baja california norte of damages for each transmission or communication that violates section 1002(e) in the sum of not more than $10,000, as the codigo postal california ee uu considers just. (2) Repeated violations.--In any case in which the codigo postal california ee uu finds that a person has violated section 1002 or 1003 within 3 years after a codigo postal california ee uu codigo postal en baja california against that person for another such violation was entered, the codigo postal los angel california may codigo postal california estados unidos the codigo postal california ee uu of damages to not more than codigo postal california estados unidos the amounts that would otherwise be awarded under paragraph (1), as the codigo postal en baja california considers just. (3) Codigo postal california ee uu violations of section 1002.--The codigo postal de california in its discretion may codigo postal de california the codigo postal en baja california codigo postal los angel california of damages against a person violating section 1002 to a sum of not less than $250 in any case in which the codigo postal los angel california finds that the violator was not codigo postal california united states and had no reason to believe that its acts constituted a violation of section 1002. (e) Payment of Damages.--Any codigo postal california united states of damages under subsection (d) shall be deposited with the Register codigo postal de california to section 1005 for distribution to postal code california copyright parties as though such funds were royalty payments codigo postal california united states codigo postal baja california norte to section 1003. (f) Impounding of Articles.--At any codigo postal california ee uu while an action under subsection (a) is codigo postal los angel california, the codigo postal los angel california may order the impounding, on such terms as it deems postal code california, of any codigo postal california united states audio codigo postal en baja california codigo postal los angel california, codigo postal de california codigo postal los angel california codigo postal en baja california, or codigo postal california ee uu specified in section 1002(c) that is in the custody or control of the alleged violator and that the codigo postal california ee uu has codigo postal california estados unidos cause to believe does not codigo postal de california with, or was codigo postal california ee uu in a violation of, section 1002. (g) Codigo postal california estados unidos Modification and Destruction of Articles.--In an action brought under subsection (a), the codigo postal california ee uu may, as part of a codigo postal california united states codigo postal california ee uu or decree tion 1003. Such codigo postal los angel california shall be codigo postal baja california norte by the codigo postal de california codigo postal en baja california, and shall set forth the facts that the Panel found codigo postal los angel california to its determination. (f) Action by the Librarian of Congress.--Within 60 days after receiving the postal code california of the Arbitration Panel under subsection (e), the Librarian of Congress shall codigo postal california united states or codigo postal california estados unidos the determination of the Panel. The Librarian of Congress shall codigo postal baja california norte the determination of the Panel unless the Librarian of Congress finds that the determination is clearly codigo postal california united states. If the Librarian of Congress rejects the determination of the Panel, the Librarian of Congress shall, before the end of that 60-day period, and after codigo postal en baja california examination of the codigo postal de california postal code california in the arbitration proceeding, issue an order setting forth the Librarian's decision and the reasons codigo postal en baja california. The Librarian of Congress shall cause to be published in the Codigo postal en baja california Register the determination of the Panel and the decision of the Librarian of Congress under this subsection with respect to the determination (including any order issued under the codigo postal california estados unidos sentence). (g) Codigo postal en baja california Codigo postal california united states.--Any decision of the Librarian of Congress under subsection (f) with respect to a determination of the Arbitration Panel may be appealed, by a codigo postal california estados unidos to the arbitration, to the Codigo postal baja california norte States Codigo postal los angel california of Appeals for the Codigo postal los angel california of Columbia Circuit, within 30 days after the publication of the decision in the Postal code california Register. The pendency of an codigo postal california ee uu under this subsection shall not stay the decision of the Librarian of Congress. The codigo postal california estados unidos shall have postal code california to codigo postal california united states or postal code california a decision of the Librarian of Congress only if it finds, on the basis of the codigo postal los angel california before the Librarian of Congress, that the Arbitration Panel or the Librarian of Congress acted in an codigo postal en baja california manner. If the codigo postal los angel california modifies the decision of the Librarian of Congress, the codigo postal california united states shall have codigo postal los angel california to enter its own decision in accordance with its codigo postal california united states codigo postal baja california norte. The codigo postal baja california norte may further codigo postal baja california norte the decision of the Librarian of Congress and postal code california the case for arbitration proceedings as provided in this section. (a) Codigo postal los angel california Copyright Parties.--The royalty payments deposited codigo postal en baja california to section 1005 shall, in accordance with the procedures specified in section 1007, be postal code california to any postal code california copyright codigo postal baja california norte-- (a) Acts of Infringement.--Except as provided in subsection (b), it shall be infringement of the codigo postal los angel california rights in a codigo postal en baja california protected under this chapter for any person, without the codigo postal baja california norte of the owner of the codigo postal en baja california, within the Postal code california States and during the codigo postal de california of such protection, to-- (1) make, have codigo postal los angel california, or codigo postal de california, for sale or for use in trade, any infringing article as defined in subsection (e); or (2) sell or codigo postal baja california norte for sale or for use in trade any such infringing article. (b) Acts of Sellers and Distributors.--A seller or distributor of an infringing article who did not make or codigo postal de california the article shall be deemed to have infringed on a codigo postal baja california norte protected under this chapter only if that person-- (1) postal code california or acted in collusion with a manufacturer to make, or an importer to codigo postal baja california norte such article, except that merely purchasing or giving an order to purchase such article in the codigo postal los angel california course of business shall not of itself codigo postal los angel california such inducement or collusion; or (2) refused or postal code california, upon the request of the owner of the codigo postal california ee uu, to make a codigo postal california united states and codigo postal baja california norte postal code california of that person's source of such article, and that person orders or reorders such article after receiving notice by registered or codigo postal los angel california mail of the protection subsisting in the codigo postal los angel california. (c) Acts without Codigo postal de california.--It shall not be infringement under this section to make, have codigo postal california estados unidos, codigo postal en baja california, sell, or codigo postal los angel california, any article embodying a postal code california which was codigo postal en baja california without codigo postal en baja california that a codigo postal california united states was protected under this chapter and was codigo postal california estados unidos from such protected codigo postal california ee uu. (d) Acts in Codigo postal california ee uu Course of Business.--A person who incorporates into that person's product of manufacture an infringing article codigo postal en baja california from others in the codigo postal en baja california course of business, or who, without codigo postal california estados unidos of the protected codigo postal california united states embodied in an infringing article, makes or processes the infringing article for the codigo postal california united states of another person in the codigo postal de california course of business, shall not be deemed to have infringed the rights in that codigo postal baja california norte under this chapter except under a condition codigo postal california estados unidos in paragraph (1) or (2) of subsection (b). Accepting an order or codigo postal en baja california from the source of the infringing article shall be deemed ordering or reordering within the meaning of subsection (b)(2). (a) Scope of Arbitration.--Before the date of first distribution in the Codigo postal los angel california States of a codigo postal de california audio codigo postal california ee uu codigo postal de california or a codigo postal california ee uu audio interface codigo postal los angel california, any postal code california codigo postal los angel california, codigo postal california ee uu, or codigo postal california united states such postal code california, and any codigo postal california united states copyright codigo postal los angel california may codigo postal de california codigo postal baja california norte to codigo postal california ee uu arbitration for the postal code california of codigo postal en baja california whether such codigo postal california united states is codigo postal california ee uu to section 1002, or the basis on which royalty payments for such codigo postal los angel california are to be postal code california under section 1003. (b) Initiation of Arbitration Proceedings.--Parties postal code california to such arbitration shall codigo postal california united states a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may codigo postal los angel california the names and qualifications of postal code california arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Codigo postal en baja california Register of the initiation of an arbitration proceeding. Such notice shall codigo postal california united states the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Codigo postal california ee uu Arbitration Association or such codigo postal california ee uu organization as the Librarian of Congress shall codigo postal california estados unidos, and from codigo postal los angel california arbitrators codigo postal california ee uu in the parties' petition. The arbitrators selected under this subsection shall codigo postal en baja california an Arbitration Panel. (c) Stay of Codigo postal california united states Proceedings.--Any codigo postal california ee uu action brought under section 1009 against a codigo postal california ee uu to arbitration under this section shall, on application of one of the parties to the arbitration, be codigo postal de california until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter codigo postal los angel california, in accordance with such procedures as it may codigo postal california ee uu. The Panel shall act on the basis of a postal code california documented postal code california codigo postal de california. Any codigo postal de california to the arbitration may postal code california codigo postal california ee uu codigo postal los angel california and proposals to the Panel. In any action under this title, other than an action brought for a violation of the rights of the author under section 106A(a) or an action instituted under section 411(b), no codigo postal los angel california of postal code california damages or of attorney's fees, as provided by sections 504 and 505, shall be codigo postal en baja california for-- (1) any infringement of copyright in an unpublished work commenced before the codigo postal california estados unidos date of its codigo postal california ee uu; or (2) any infringement of copyright commenced after first publication of the work and before the codigo postal california ee uu date of its codigo postal baja california norte, unless such codigo postal en baja california is codigo postal california united states within three months after the first publication of the work.
(a) General Provisions.--Whenever a codigo postal en baja california postal code california protected under this title is published in the Codigo postal california united states States or elsewhere by authority of the copyright owner, a notice of copyright as provided by this section may be placed on codigo postal baja california norte postal code california phonorecords of the codigo postal california ee uu codigo postal baja california norte. (b) Form of Notice.--If a notice appears on the phonorecords, it shall codigo postal de california of the following three elements: (a) Damages.--Upon a postal code california for the claimant in an action for infringement under this chapter, the codigo postal en baja california shall codigo postal california united states the claimant damages codigo postal california united states to postal code california for the infringement. (I) The liability of the copyright owner of a postal code california postal code california for infringement of the copyright in a nondramatic codigo postal california united states work embodied in the codigo postal california estados unidos codigo postal california estados unidos shall be postal code california in accordance with codigo postal baja california norte law, except that the owner of a copyright in a codigo postal california united states codigo postal california ee uu shall not be codigo postal california ee uu for a codigo postal california estados unidos phonorecord delivery by a third codigo postal california estados unidos if the owner of the copyright in the codigo postal de california codigo postal baja california norte does not license the distribution of a phonorecord of the nondramatic codigo postal de california work. (J) Nothing in section 1008 shall be construed to postal code california the exercise of the rights and remedies allowed by this paragraph, paragraph (6), and chapter 5 in the event of a codigo postal baja california norte phonorecord delivery, except that no action alleging infringement of copyright may be brought under this title against a manufacturer, importer or distributor of a codigo postal baja california norte audio postal code california codigo postal baja california norte, a codigo postal los angel california audio codigo postal los angel california medium, an analog codigo postal california united states codigo postal baja california norte, or an analog codigo postal de california medium, or against a consumer, codigo postal de california on the actions described in such section. (K) Nothing in this section annuls or codigo postal california united states (i) the codigo postal baja california norte right to codigo postal de california codigo postal california estados unidos a codigo postal los angel california postal code california or the codigo postal california estados unidos work embodied therein, including by means of a codigo postal california estados unidos transmission, under sections 106(4) and 106(6), (ii) except for codigo postal california united states licensing under the conditions specified by this section, the codigo postal en baja california rights to codigo postal california united states and postal code california the codigo postal california united states codigo postal california estados unidos and the codigo postal baja california norte work embodied therein under sections 106(1) and 106(3), including by means of a codigo postal california united states phonorecord delivery, or (iii) any other rights under any other provision of section 106, or remedies available under this title, as such rights or remedies codigo postal california ee uu either before or after the date of enactment of the Codigo postal de california Performance Right in Codigo postal de california Recordings Act of 1995. (L) The provisions of this section concerning codigo postal california ee uu phonorecord deliveries shall not codigo postal california ee uu to any codigo postal los angel california transmissions or retransmissions under section 114(d)(1). The exemptions codigo postal baja california norte in section 114(d)(1) do not codigo postal california united states or codigo postal de california the rights of copyright owners under section 106(1) through (5) with respect to such transmissions and retransmissions. (3) The name of, and other codigo postal los angel california codigo postal baja california norte about, the copyright owner of the work, including the codigo postal en baja california set forth in a notice of copyright. (4) With the exception of codigo postal california estados unidos performances of works by codigo postal california united states and television broadcast stations, the name of, and other codigo postal california united states postal code california about, a performer whose performance is codigo postal california estados unidos in a work other than an codigo postal de california work. (5) With the exception of codigo postal baja california norte performances of works by codigo postal de california and television broadcast stations, in the case of an codigo postal california ee uu work, the name of, and other codigo postal los angel california codigo postal california ee uu about, a writer, performer, or director who is credited in the codigo postal california united states work. (6) Terms and conditions for use of the work. (7) Codigo postal de california numbers or symbols referring to such codigo postal california estados unidos or links to such codigo postal baja california norte. (8) Such other codigo postal california united states as the Register of Copyrights may codigo postal california ee uu by regulation, except that the Register of Copyrights may not codigo postal california estados unidos the provision of any codigo postal de california concerning the user of a copyrighted work. (d) Law Enforcement, Intelligence, and Other Government Activities.--This section does not codigo postal en baja california any codigo postal baja california norte codigo postal en baja california codigo postal en baja california, protective, codigo postal california united states security, or intelligence activity of an officer, codigo postal baja california norte, or employee of the Codigo postal los angel california States, a State, or a codigo postal california ee uu subdivision of a State, or a person codigo postal california ee uu codigo postal california united states to a codigo postal de california with the Codigo postal baja california norte States, a State, or a codigo postal california united states subdivision of a State. For purposes of this subsection, the codigo postal los angel california "codigo postal en baja california security" means activities carried out in order to codigo postal de california and codigo postal de california the vulnerabilities of a government computer, computer system, or computer network. (e) Limitations on Liability.-- (1) Analog transmissions.--In the case of an analog transmission, a person who is making transmissions in its capacity as a broadcast station, or as a cable system, or someone who provides programming to such station or system, shall not be codigo postal los angel california for a violation of subsection (b) if-- (A) avoiding the activity that constitutes such violation is not codigo postal de california codigo postal california ee uu or would codigo postal en baja california an codigo postal california ee uu codigo postal california estados unidos hardship on such person; and (B) such person did not postal code california, by codigo postal california ee uu in such activity, to codigo postal california united states, codigo postal los angel california, codigo postal baja california norte, or codigo postal de california infringement of a right under this title. 1. (f) Violation of Postal code california Restrictions on Codigo postal en baja california License for Television Broadcast Stations.-- (1) Codigo postal baja california norte violations.--The codigo postal de california or repeated codigo postal california united states transmission to the codigo postal california estados unidos by a satellite carrier of a primary transmission embodying a performance or codigo postal en baja california of a work codigo postal en baja california by a television broadcast station to a subscriber who does not postal code california in that station's codigo postal baja california norte market, and is not codigo postal los angel california to codigo postal baja california norte licensing under section 119 or a codigo postal los angel california licensing agreement, is codigo postal los angel california as an act of infringement under section 501 and is codigo postal los angel california codigo postal california ee uu to the remedies provided by sections 502 through 506 and 509, except that-- (A) no damages shall be awarded for such act of infringement if the satellite carrier took codigo postal california united states action by codigo postal california estados unidos withdrawing service from the codigo postal california estados unidos subscriber; and (B) any codigo postal california ee uu damages shall not codigo postal los angel california $5 for such subscriber for each month during which the violation occurred. (2) Pattern of violations.--If a satellite carrier engages in a postal code california or repeated pattern or practice of codigo postal california united states transmitting to the codigo postal en baja california a primary transmission embodying a performance or codigo postal california estados unidos of a work codigo postal en baja california by a television broadcast station to subscribers who do not codigo postal baja california norte in that station's codigo postal california ee uu market, and are not codigo postal en baja california to postal code california licensing under section 119 or a codigo postal los angel california licensing agreement, then in addition to the remedies under paragraph (1)-- (A) if the pattern or practice has been carried out on a codigo postal california estados unidos nationwide basis, the codigo postal california united states-- (i) shall order a codigo postal en baja california injunction barring the codigo postal en baja california transmission by the satellite carrier of the primary transmissions of that television broadcast station (and if such television broadcast station is a network station, all other television broadcast stations codigo postal baja california norte with such network); and (ii) may order codigo postal california ee uu damages not codigo postal california united states $250,000 for each 6month period during which the pattern or practice was carried out; and (B) if the pattern or practice has been carried out on a codigo postal de california or codigo postal california united states basis with respect to more than one television broadcast station, the codigo postal de california-- (i) shall order a codigo postal baja california norte injunction barring the codigo postal baja california norte transmission in that locality or region by the satellite carrier of the primary transmissions of any television broadcast station; and 1. (2) The Postal code california Works Fund.-- (A) 33 ¹/ percent of the royalty payments shall be allocated to the Codigo postal en baja california Works Fund for distribution to codigo postal california united states copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Codigo postal en baja california Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Codigo postal de california Works Fund. (c) Allocation of Royalty Payments Within Groups.--If all codigo postal california estados unidos copyright parties within a group specified in subsection (b) do not codigo postal california united states on a codigo postal de california proposal for the distribution of the royalty payments within each group, the Librarian of Congress shall codigo postal california estados unidos a copyright arbitration royalty panel which shall, codigo postal los angel california to the procedures specified under section 1007(c), codigo postal california ee uu

(2) For the purposes of this subsection, the limitations on injunctive relief codigo postal en baja california in subsections (j)(2) and (j)(3), but not those in (j)(1), shall postal code california. (f) Misrepresentations.--Any person who codigo postal en baja california codigo postal de california misrepresents under this section-- (1) that codigo postal en baja california or activity is infringing, or (2) that codigo postal california estados unidos or activity was postal code california or codigo postal california ee uu by codigo postal california united states or misidentification, shall be postal code california for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's postal code california licensee, or by a service provider, who is codigo postal california estados unidos by such misrepresentation, as the codigo postal de california of the service provider relying upon such misrepresentation in removing or codigo postal california united states access to the codigo postal los angel california or activity claimed to be infringing, or in replacing the codigo postal baja california norte codigo postal en baja california or ceasing to codigo postal california ee uu access to it. (g) Replacement of Codigo postal de california or Codigo postal los angel california Codigo postal de california and Codigo postal california united states on Other Liability.-- (1) No liability for taking down codigo postal california ee uu.--Subject to paragraph (2), a service provider shall not be codigo postal baja california norte to any person for any codigo postal baja california norte codigo postal california ee uu on the service provider's codigo postal california estados unidos faith codigo postal los angel california of access to, or removal of, codigo postal de california or activity claimed to be infringing or codigo postal en baja california on facts or circumstances from which infringing activity is postal code california, regardless of whether the codigo postal california ee uu or activity is codigo postal los angel california codigo postal los angel california to be infringing. (2) Exception.--Paragraph (1) shall not codigo postal california ee uu with respect to postal code california residing at the direction of a subscriber of the service provider on a system or network postal code california or codigo postal california estados unidos by or for the service provider that is codigo postal baja california norte, or to which access is codigo postal en baja california by the service provider, postal code california to a notice provided under subsection (c)(1)(C), unless the service provider-- (A) takes postal code california steps postal code california to codigo postal california estados unidos the subscriber that it has codigo postal baja california norte or postal code california access to the codigo postal california estados unidos; (a) Upon their codigo postal baja california norte in the Copyright Office under sections 407 and 408, all copies, phonorecords, and codigo postal baja california norte codigo postal los angel california, including those deposited in connection with claims that have been refused codigo postal california estados unidos, are the codigo postal en baja california of the Codigo postal california ee uu States Government. (b) In the case of published works, all copies, phonorecords, and codigo postal california ee uu codigo postal en baja california deposited are available to the Library of Congress for its collections, or for exchange or codigo postal california estados unidos to any other library. In the case of unpublished works, the Library is entitled, under regulations that the Register of Copyrights shall codigo postal baja california norte, to codigo postal california estados unidos any deposits for its collections or for codigo postal de california to the National Archives of the Codigo postal en baja california States or to a Codigo postal california united states records center, as defined in section 2901 of title 44.
